Police Force Defecation and Surgery After Driver Clenched Butt Cheeks During Traffic Stop 

 

New Mexico court documents state that Eckert was driving out of Wal-Mart in Deming when he failed to fully stop at a parking lot stop sign. He was immediately pulled over.

When he stepped out of his vehicle, an officer reported that he appeared to be clenching his buttocks. That fact was cited as probable cause to suspect that Eckert was hiding narcotics in his anal cavity. Officers obtained a search warrant and Eckert’s humiliating examination began at a nearby medical center.

 

  1. Eckert’s abdominal area was X-rayed; no narcotics were found.
  2. Doctors then performed an exam of Eckert’s anus with their fingers; no narcotics were found.
  3. Doctors performed a second exam of Eckert’s anus with their fingers; no narcotics were found.
  4. Doctors penetrated Eckert’s anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
  5. Doctors penetrated Eckert’s anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
  6. Doctors penetrated Eckert’s anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
  7. Doctors then X-rayed Eckert again; no narcotics were found.
  8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert’s anus, rectum, colon, and large intestines. No narcotics were found.

The Associated Press reports that the city of Deming, New Mexico, where David Eckert was pulled over for a rolling stop last January, and nearby Hidalgo County have agreed to settle a civil rights lawsuit he filed after cops from those two jurisdictions forced him to undergo a humiliating exploration of his digestive tract. The city and county will pay Eckert $1.6 million, which amounts to $200,000 for each of the increasingly intrusive searches performed on Eckert at Gila Regional Medical Center in Silver City: two X-rays, two digital probes of his anus, three enemas, and a colonoscopy, none of which discovered the slightest trace of the drugs that police claim to have thought he was hiding inside himself. Eckert also sued various Deming and Hidalgo County police officers; the hospital, which billed him more than $6,000 for these indignities; and two physicians, Robert Wilcox and Okay Odocha, who executed the elaborate assault under the cover of medicine.

“It was medically unethical and unconstitutional,” Shannon Kennedy, Eckert’s attorney, told A.P. “He feels relieved that this part is over and believes this litigation might make sure this doesn’t happen to anyone else.” Eckert added:

“I feel that I got some justice as I think the settlement shows they were wrong to do what they did to me. I truly hope that no one will be treated like this ever again. I felt very helpless and alone on that night.”

Although this measure of justice is welcome, it is too bad we may never get a definitive ruling on the legality of Eckert’s dehumanizing ordeal, which was inflicted based on a search warrant that police obtained by claiming a drug-detecting dog “alerted” to the driver’s seat of Eckert’s pickup truck. They also said he seemed nervous and was standing with his legs together, which suggested to them that he was concealing contraband up his butt. That last detail received a lot of attention, but it seems clear that the warrant would not have been issued without the alleged dog alert. The Supreme Court has said such evidence by itself provides probable cause for a search unless the suspect can show the dog is unreliable—an opportunity that does not arise until long after the search is carried out.

    The officers that decided to push forward with this investigation are incredibly pathetic human beings. If they haven’t been diagnosed with some sort of illness, they need to be ASAP. The officer or officers involved require medication and must be investigated. I’m wondering if this wasn’t a personal vendetta? Or maybe the officer belongs to a gang? I don’t know. Everybody already knows that these officers are pathetic, I just feel the need to say it.

      This is just unreal. Even IF he DID have something up there, everything that followed the initial “pat down” was ridiculous. Even if he was hiding something, he couldn’t have been hiding THAT MUCH. If you’re hiding narcotics in yourself, you’re probably addicted to them which means you feel as if you need them more than regular people feel they need AIR.     This is ridiculous and the Dr’s should have refused for medical reasons. Repeat enemas are not healthy and invasiveness when there is no evidence each step of the way- using sedation which has hazards, a colonoscopy which ALSO has hazards is police power run mad.
    i hope NM get a Federal Investigation and those involved are fired. i would think the AMA would have something to say about the Dr’s cooperating in invasive and unnecessary procedures.

      This doctors at the first hospital did refuse. Apparently they stated that it was unethical, so the cops took him to another hospital (which apparently had no issue performing the ridiculous and unwarranted tests). Furthermore, the “warrantless warrant” was only valid in the county where the first hospital was located, so the police and the second hospital broke the law… as if the whole thing isn’t a complete mockery of the law. I hope that his settlement is in the millions.

      There are a couple of pieces to this story that are missing here. The first ER they took him to, refused to to do what the cops wanted them to do. The hospital said it was unethical. The hospital that finally did the violating was in a completely different county. I see some big lawsuits here.

    Honestly if you haven’t found anything after even 2 exams and an xray, the rest of the invasive procedure is completely unconstitutional. Also the FACT that the warrant was only valid in the county of the traffic incident and that the procedure was performed in a separate county is illegal, and the police obviously violated several laws in the brute force, and basically third world way of dealing with an issue. I am glad that Eckert is taking action against the officers and police force of that county. Plus the fact that no party that performed this act will comment proves they know that they broke the law, and then this idiot police chief saying they “follow the law” is complete bull! This just makes me sick to know that I apparently now live in a country were this can happen and be forced upon us by our government.

    My father in law lives in Deming (and is a Vietnam Vet)…way out in the desert. Every time he has to go out to town for something, which he tries to limit to once a month or less, he is harassed by the cops there. It has been something as simple as merely checking his ID and running it to see if he is “wanted” to patting him down for no reason. He suffers severely from PTSD, and is not the most comforting person to look at, but he is a good man. Those Deming police are super crooked.

      I live not far from Deming N.M. and the cops are bad on the county and city level any way! We were Robbed and the county Authorities did nothing about it! When we Me and my husband became evolved they “the County (Sheriff)” Threatened us and told us to back off or we would find our selves in a situation that would cost us our family! Very Bad News! My Great Grand Father was the Sheriff in the town I am from, He was a honest good Man! Its a shame that things have become so corrupt over the years! I love New Mexico and I love the Small Town I live in! This does not define the great people that lives here and run businesses that are reputable!     This is so disguisting I don’t even know what to say. Everyday I hear more and more terrible stories regarding cops using their power in the wrong ways. What is wrong with these people??!? The screening process to become a police officer needs to change and require MUCH more scrutiny, including looking into past medical history (with a strong emphasis on mental illness, possibly undiagnosed), more thourough background checks, and accounts from previous employers, teachers, fellow classmates from high school, etc. Too many of these cops are just looking for a power trip, or to make up for the fact that they were total losers in high school. They aren’t interested in upholding the law, and most of them are the some of the dumbest people I’ve met. Makes me sick. “To Serve and Protect”…YEAH RIGHT!!!

I have to say that things like this are not uncommon anymore. Some of it has to do with law enforcement not being given complete psychological exams for certain issues. The doctors do as they are told if in the prison or jail system and usually are very bottom of the class graduates in med school. The worst.
    I had one of the kids I knew ,around age 17 get put into top floor at Wa state and he was full of balloons. He told the guards and the doctors and the guy in the cell with him he needed to get rid of 4-5 balloons before they broke. They broke and the other cellmate screamed for help and the guards did nothing. They found the young man dead in the morning and the cellmate going totally off the wall. The parents wentto court and the cell mate was not to be found. “Must had skipped town”

    Maybe the reason he didn’t stop completely at the stop sign could be that he needed to go to the washroom and that could be why he had his butt clenched, that is really unacceptable what the police done to him.
